Texting (TCPA)

SMS marketing lives or dies on plumbing: how consent is captured at the form, what the disclosure next to it says, whether opt-outs actually stop the messages, and what records exist to prove all three. Demand letters and TCPA suits test the plumbing, not the intent. The fix is engineering — the signup flow, the disclosure copy, the opt-out path, and the consent records — built to match what your counsel says the law requires of you.

Tracking (California wiretapping theories)

A wave of lawsuits under California's wiretapping and privacy statutes targets the gap between what a privacy policy says and what the site's tags actually do: analytics pixels and session-replay scripts firing before any consent, chat transcripts shared with vendors, trackers the policy never mentions. The fix starts with ground truth — an inventory of every tag, what it sends, to whom, and when it fires — then conditioning or removing what shouldn't fire, and bringing the disclosure in line with reality.

What I deliver

  1. The inventory — free. For texting: the consent flow as it exists, gap by gap. For tracking: every tag, its vendor, its payload, its firing condition — measured on the live site, not assumed from the policy.
  2. Implementation. Corrected forms, disclosure copy, opt-out plumbing, tag conditioning or removal — real changes in the theme and tag manager. One fixed number, known before anything starts.
  3. Documentation. A dated record of the corrected state — what changed, where, and when — for counsel's file.
